On Thursday, March 16th, 2024, the national organizations Moms for Liberty, alongside Kansas, Alaska, Utah, Wyoming, Young America's Foundation, Female Athletes United and Minor K.R., represented by her mother, filed a lawsuit against the Biden Administration to halt its overhaul of Title IX, an unconstitutional move that seeks to undermine the fundamental principles of liberty, equality and privacy in our schools.
Led by Southeastern Legal Foundation (SLF), the organizations are representing members whose First Amendment rights are under attack by the Biden Department of Education's new regulations. The plaintiffs' statement alleges "These regulations not only jeopardize the rights of parents, but also infringe upon students' freedoms, punishing them for expressing beliefs in biological sex and coercing them to endorse ideologies on gender fluidity, transgenderism, and queer theory."
These regulations threaten to undermine parental authority in K-12 education by imposing "gender identity" mandates. Under this new federal language, students could face discipline or other consequences for using incorrect pronouns or expressing discomfort with sharing facilities with those of the opposite sex.
Cited in the complaint are the concerns of four Moms for Liberty members: Merianne Jensen, Tricia Plank, Debbie Lochner, and Rebekah Koznek, whose children are already feeling the impact of these intrusive policies. From unconstitutionally compelled speech to uncomfortable locker room situations, to biological males competing on female-only sports teams, our children’s dignity, privacy, and safety are at stake.
The Biden Administration's Title IX guidance will go into effect August 1, 2024. It is seen by many as an overreach by the Department of Education and is created to usurp state laws and FERPA as well as the constitutional right to free speech.
